The final humiliation

I wonder how many of you out there have lost not just your possesions but your dignity as well? Tonight I am sad, the reason been is because I have to sell everything I own today as I have been given notice to move out within 2 days and I agreed to that. I am a brocken man, disilusioned and disappinted by been let down by the Labour Law of this country.

To have to go through seeing your fellow workers with no income to feed and clothe not just themselves but their families. How many families have been disrupted by the only bread winners not having an income, not to say even the grace to recieve UIF which was paid by the company up to 2004 but not 2005 even though it was deducted from our salaries.

I have failed collegues and myself. I have been working 312 hrs nightshift 7 days a week and one day off for 2500.00 a month no double pay on sundays or public holidays whatsoever....

I have struggled to get hold of my previous employer to comply with anything that I have asked. He just did not care a dam and thinks he can get away with leaving us in this mess with nothing....I am in pain because of my rotting teeth which need to be pulled out and failing eye sight due to my glasses been so old...

My dignity and right to life has been compremised by my previous employer I am full of shame because I tried to do the best I could for all of us to get a retrenchement package and outstanding wages but have failed....I am depressed becuase this is the last straw the final blow......

Even though I was very ill I remained at my post and worked many many hours and I got nothing in return and this is not on. At lease my employer could have had the decency to fax through the UIF19 forms to the department of labour and that would have given us some money to survive....

If he had done this I would not be in the trouble that I now find myself in...It would have given me some way to look for another job and be able to give Robert the care that he needed but no, he did not even do this

The hours are so long here and i was booked off last week for a week due to been ill I am so tired emotionaly tired I need to speak to someone I really do need help

all i want is what is due to us, how can goverment hold us accountable for the actions of our employers and leave us without food and the possibility of loosing the very roof over our heads.

we where referred to the ccma but i had to refax the claim to the owner and he was fuming and asked me to hold on for the liquidation and that they where going to sell the bussiness and we with it.

this went on for more than three months and then nothing....

the money he deducted from my wages and the many other things he did to us is wrong for example he put us round a table about 11 of us and told us we must decide from an about of 2400 who was going to get what..how could he do such a thing!!!!

Not only that he was recieving payment for the parking bays while we where closed and did not even offer us one cent to help us. he never gave us a written statement saying that we where been retrenched he just said hold on and then dissapeared and that was that

there are clients looking for him due to debt and no one can get hold of him. why can he go out be able to pay his rent and party on the weekends and his former staff be homeless and hungry i demand an investigation and a forensic audit on his company and his personal banking account and properties that he might have to uncover the truth.

if he can afford to continue his lifestyle without the bussiness then he has income from other sources such as his web sites ect.

PLEASE HELP CAN SOMEONE INVESTIGATE HELP ME TO REGAIN MY/OUR DIGNITY AND THE RIGHT TO LIFE PLEASE I AM BEGGING ANYONE WHO READS THIS HELP ME HELP US!!!!!!!!!!!!

I CANT HANDLE ANYMORE CALLS FROM MY FELLOW WORKERS ITS TOO MUCH AND THEY DONT UNDERSTAND THAT I HAVE TRIED EVERYTHING BUT.....I HAVE LET THEM DOWN.

I do have supporting documents please someone help...

my phone number is 0762802833

Update may be my last for a week or so

Well its been along time since I have updated my blog so here go's. Nothing much has changed in my struggle for justice and I am still working 312hrs night shift a month that is seven days night shift and then one day off. I have been so tired and stressed from all the shit that has been going on.

  1. Still have not heard from Phil Buchler my previous boss
  2. I have lost the flat
  3. Have sent emails to You magazine and so on to tell them the story
  4. Been to Patracia de Lille on the same day she announced the manefesto
  5. Not able to make appointments with them to take the matter further due to time and myself been tired
  6. Been booked of sick due to been ill and that is my immune systerm can only handle so much and that was this week
  7. Been in contact with The Voice Newspaper and once again slept past my appointment with them today but did call to have another
  8. I have to sell everything and move out on this thursday
  9. i have lost my dignity and almost my self-respect
I would like to thank Malan Laubcher my landlord for been so patient with me since the passing of my life partner Robert last year. But of course with no estate I could not pay the rent and not enough money from my salary to pay rent

I would like to thank Garth for giving me money to help me buy food and survive. I have come to the end of my wits and will try everything in my power to bring to justice those who have left myself and fellow workers withoug income and will not stop until my plea is heard I will not give up my faith in the constitution and labour act of this my country

I feel let down by the governing laws of this country. There are so many questions that I would like to ask and they are the following
  • How could a company after been charged with non uif payment not be listed on the dept of labour's system
  • why did i have to get the UIF/PAYE number from the Reciever Of Revenue and why was it refused by the dept of labour
  • i was told it could only be accepted if the owner faxed a copy of the uif19 form to another department who then would load it on the system
  • no matter how i tried to explain the urgency i was reffered to the CCMA
  • which went on strike
  • I communicated and faxed the owner and physicaly went to him and begged him to send in the uif forms so that we could at least claim
  • he did not do this
  • who could the city council let him operate without everything been approved
  • how can the owner walk away scott free without obligation
these are just some of the questions that i would like to ask. why has goverment let us down why did we have to go hungry

Well its been a very

Well its been a very long December 2005 not every thing went to plan, I lost two of my dear friends to the pandemic and that was just in four days of each other and that is so sad. I thank God that I have survived so long and am in sort of good health. My viral load is 0 and my Cd4 count is up to 398 and that is dam good from the previous year when I was really so ill as you can see from the previous entries

At the moment I am not too well I went to hospital on Tuesday disorientated, high fever and dizzy. My doctor booked me off for a week and my temp was 39c and that is not good. I have not had any proper rest since the closure of Steamers and have been under constant high stress levels. Sometimes there has been days where I have had no food or money but I have just carried on and had to do things myself, this is really sad. After all the emails of help I sent out to friends mostly I got sympathy but no help.

Working 7 days a week nightshift without enough rest has caught up with me and I am exhausted and now have become ill due to some infection. How would you like you day to be like this, wake up at 3pm go to work at 5 pm and come home the next day at 7am and the cycle continues day after day. Even on your only day off you sleep and this is not on. Never mind when the person you work for once again I find myself in this predicament does not comply with the labour law and you have to suffer the consequences.

I am quite sad that this government does not do enough to help guys like me, and those who are in a similar situation, due to their employer’s absolute contempt for the labour law or the Constitution Of South Africa without conscience. The reason been because the people they employ will not take them, as they are too scared to do so for loss of their jobs. Such is the sad situation we find ourselves in.

But what has made me go over the edge, is that I have lost not just my income but life partner and seen my colleagues go hungry as I have and there is not a dam thing I can do, due to all the red tape involved with government.

There has to be someone out there they can help! For gods sake fellow South Africans, we just cant sit back and let this happen.

Thanks Mark
